Enhancing Legal Knowledge in Engineering for ADR

At the Top Engineers and Architects in the Middle East Summit 2025, a study was conducted on alternative dispute resolution methods in project management practices that lead to sustainable outcomes, within the framework of a separate presentation by engineer and practitioner Haitham K. M. Mokhtar. He emphasized the need for professionals from the Philippines in the field of engineering and architecture to bridge the gap in legal knowledge, obtaining necessary certifications for the effective practical application of alternative dispute resolution methods. Mokhtar also highlighted the necessity to increase awareness of these methods among industry professionals, suggesting that they are essential for creating sustainable results in large projects.

The expert discussed the complexity of construction projects, where the involvement of multiple interested parties and high stakes often leads to conflicts. He pointed out that timely and effective resolution of disputes through methods such as mediation, arbitration, conciliation, and the establishment of expert opinions and adjudication is necessary to avoid lengthy and costly litigation processes.

Mokhtar reminded industry professionals about the need to include clearly formulated arbitration points in contracts to avoid legal complexities. He stated: "If you are a professional or a contracting engineer, or someone preparing a contract or an order for procurement, as a technical specialist, do not think only about the technical side or the engineering aspect in the agreements you create, but also consider the legal ramifications that may arise later when a dispute occurs."
